Texas Board of Nursing adopts new rule for nursing licenses

The Texas Board of Nursing (BON) recently announced adoption of a new rule. After reviewing public comments at its April 23, 2026 meeting, the Board adopted 22 Texas Administrative Code § 217.8. The rule addresses verification of legal presence and license eligibility for nurses practicing in the Lone Star State.

What the new rule means for Texas nurses

The newly adopted regulation establishes clear requirements to verify that all individuals licensed to practice nursing in Texas are legally present in the United States and authorized to work under applicable laws. This rule affects both current license holders and those seeking initial licensure in Texas.

Filed with the Texas Register on May 14, 2026, the rule will officially take effect on June 3, 2026. Texas nurses should familiarize themselves with these requirements to ensure their licenses remain in good standing.

Key provisions of the rule

Whether already holding a nursing license or looking to apply in the future, it is important for nurses throughout Texas to know the following about this new rule:

  • The rule requires verification of legal presence in the United States for all nursing license applicants and renewals
  • Nurses must demonstrate work authorization under both state and federal law
  • The Board will implement verification procedures to ensure consistent application of the rule

Qualifying documentation for identification can include a driver’s license with REAL ID, a United States birth certificate, a valid passport and a Permanent Resident Card that does not expire before the nursing license expiration date.

Tips to ensure your license remains in good standing

Texas nurses are wise to review current documentation to ensure it meets legal presence and work authorization requirements, prepare verification documents before license renewal deadlines and stay informed about any additional guidance the Board releases regarding implementation.
