The hammer falls on Texas doctor convicted of health care fraud

As our regular Austin legal blog readers know, we have more than once written about the ongoing case of a 60-year-old Dallas-area doctor. People across Texas have been wondering when the hammer would fall on Jacques Roy and how hard it would hit.

Those questions have been answered: Roy is to spend the next 35 years in prison and pay more than $268 million dollars in restitution for a “large-scale, sophisticated healthcare fraud scheme.”

The scheme siphoned hundreds of millions of dollars out of Medicare and Medicaid and into companies owned by Roy and co-defendants, prosecutors said. The companies included Apple of Your Eye Health Care Services, Medistat Group Associates, Ultimate Care Home Health Services and Charry Home Care Services.

As we have noted before, the scheme involved recruitment of people (including some from a homeless shelter) to sign up for home health care. Documents were falsified to expedite and ensure that applicants were approved for services that they did not need and did not receive.

Fake plans of care were certified without required doctor evaluations, though the submitted documents showed that Roy signed off on them.

The Department of Justice said Roy would make in-home visits that weren’t needed and then order patient services that weren’t necessary.

“The only thing more stunning than…the shameless methods” used in the scheme said U.S. Attorney John Parker, “is the staggering dollar amounts involved.” He added that it “takes brazen to a whole new level.”
