CMS investigates MD Anderson, finds “serious care deficiencies”

MD Anderson Cancer Center is known throughout the country for its cancer treatment. This facility often takes on some of the most difficult cancer cases in the country. The cancer center’s reputation recently took a hit after a government agency conducted multiple investigations and found “serious care deficiencies.”

What led to the investigation?

The United States Centers for Medicare and Medicaid Services (CMS) conducted two investigations after the facility reported an adverse event. It is public knowledge that the event was related to a blood transfusion, but specific details of the deficiencies discovered during the investigations have not yet been released.

However, we are aware that after the investigation, the CMS found the cancer center was failing to comply with the following areas:

  • Quality assessment
  • Performance improvement
  • Patient rights
  • Nursing services
  • Lab services

CMS did not rescind the facility’s Medicare status. However, CMS has required the facility submit a plan detailing how it will correct the issues discovered within the lab during the investigations.

Due to the findings, MD Anderson is also under review by the Texas health department to ensure the facility complies with all necessary changes.

What can other facilities learn from this case?

Even the largest facilities can have issues. It can help to conduct internal audits to proactively address any problems before they become a bigger issue. Those who are the subject of a government investigation are wise to take the matter seriously. An attorney experienced in legal issues involving hospitals and government agencies can help your facility navigate the process.
