2 TX doctors face repercussions from DOJ and TMB for false claims

Physicians and other medical professionals that face allegations of wrongdoing can find themselves dealing with more than just a government investigation. In many cases, these allegations can result in action by the state licensing board.

Government makes allegations, allege millions in false claims

The government has stated the physicians submitted false claims for reimbursement from Medicare and TRICARE, a government sponsored health care program run through the Department of Defense, for toxicology and DNA cancer screening tests. The government has claimed the physicians did not even establish a patient-doctor relationship with the recipients of the tests prior to the reimbursement requests.

The government has accused one physician of submitted over $69 million in false and fraudulent claims to Medicare, the other over $36 million in false and fraudulent claims to TRICARE.

Allegations lead to TMB investigation, puts medical licenses at risk

As a result of these allegations, the Texas Medical Board (TMB) has suspended both physicians’ medical licenses. The physicians are expected to attend a hearing before the state’s Medical board to fight for their medical licenses.

Lessons for other physicians facing similar accusations

The response to this investigation is not uncommon. It serves as a reminder for physicians and other medical professionals to take similar allegations of wrongdoing seriously. The allegations can result in a lengthy investigation and can have an immediate impact on your ability to practice your profession and serve your patients. An attorney experienced in health care law issues like these can review the situation and discuss your options.
