TX doctor's medical license suspended, allegations of assault

The Texas Medical Board (TMB) recently suspended the medical license of a family and occupational doctor. The TMB moved forward with the suspension based on allegations of improper prescriptions of drugs and sexual assault of two patients. The TMB stated at this time, the physician's suspension is listed as "temporary."

The suspension is based on three allegations:

  • Sexual assault. Two patients accused the physician of improper, sexual contact. The first patient stated that she experienced hip pain and the doctor inappropriately touched her during an exam. The second patient stated she suffered from back pain and alleged the doctor inappropriately touched her during a procedure.
  • Inappropriate financial involvement. Another patient accused the doctor of inappropriately borrowing money. The physician allegedly borrowed money on three different occasions from the patient. Once for $5,000, a second time for $10,000 and a third for an additional $5,000.
  • Improper pain treatment. The physician allegedly prescribed dangerous controlled substances to a patient with a known history of drug abuse. The TMB is looking into whether the physician continued with prescriptions which included Diazepam and Opana after he was made aware of the patient's admission into a substance abuse facility.

It is unclear if the state will pursue criminal charges from these allegations. A recent report notes that the patients making these claims state they filed charge with the local police department. However, the local police department has stated the physician does not currently face criminal charges.

The Texas Medical Board is investigating. The TMB will determine if further action against the physician is required once the investigation is concluded.

A medical professional that finds themselves the subject of an investigation by the TMB for similar charges is allowed to have representation. An attorney experienced in disciplinary actions and investigations can provide counsel to help better ensure a favorable outcome.
