Since joining Rivas Goldstein, LLP in 2011, Jonathan W. Wu has helped healthcare clients navigate the complex system of Medicare/Medicaid regulatory requirements for provider enrollment, licensing standards, billing compliance and reimbursement. Jonathan has represented numerous clients respond to federal and/or state governmental agency investigations (DHHS, OIG, HHSC-OIG, MFCU, etc.) initiated to detect potential fraud, waste or abuse. These investigations can lead to formal administrative actions (i.e., overpayments, recoupments, payment suspensions, civil money penalties, contract terminations, revocations, exclusions, etc.) and even criminal liability. Jonathan has successfully represented individual practitioners (i.e., physicians, dentists, ST/OT/PT therapists, professional counselors, etc.) and health care businesses (i.e., drug testing laboratories, research and treatment facilities, pharmacies, DMEs, home health agencies, hospices, etc.) to resolve, contest and litigate these actions at every level of administrative appeal and beyond.

Jonathan has also helped Medicare/Medicaid providers to implement compliance measures, quality assurance programs, and review existing billing and treatment policies to minimize future risk. For providers who suspect a potential billing or reimbursement error, Jonathan has helped them to properly and safely disclose those issues to Medicare and/or Medicaid according to proper OIG "self-disclosure" protocols which may prevent a future, costly enforcement investigation or sanction.

Jonathan also has extensive experience defending clients in professional licensure disputes with state licensing boards (e.g., Medical Board, State Board of Dental Examiners, Board of Nursing, State Board of Pharmacy, Board of Examiners of Professional Counselors, Speech-Language Pathology and Audiology, etc.). Jonathan has consistently achieved favorable results, in part, by creating specialized strategies unique to each client's situation and by maximizing every available opportunity for appeal or negotiation (e.g., informal settlement conferences, public committee hearings, mediations, administrative trial, reinstatement/modification hearings, state court judicial review, etc.).

Jonathan's practice also includes representing healthcare providers in commercial litigation of contract disputes common within the healthcare community (e.g., covenants not-to-compete, non-disclosure agreements, non-solicitation agreements, etc.). Jonathan has also represented healthcare clients in litigation arising from purchase agreements, management/operating agreements, indemnity provisions as well as reimbursement contracts with private insurance.

Prior to joining Rivas Goldstein, LLP., Jonathan was a staff attorney at Lone Star Legal Aid in Houston, TX representing clients in administrative hearings and appeals against governmental and administrative agency actions involving public entitlements (e.g., Medicare, Medicaid, Social Security Disability, SNAP, Unemployment, etc.).
