John J. Rivas provides legal representation to clients in the areas of health care, criminal and administrative law litigation, as well as Medicaid and Medicare fraud and related “white collar crime” matters. In addition to state court, he is also admitted to practice before the United States District Court for the Western District of Texas. John's practice includes the representation of home health agencies, physicians, nursing homes, and other licensed health professionals and entities in practice and business matters, as well as their representation and defense before their respective state licensure and peer review boards such as the Texas Medical Board, Texas Department of Aging and Disability Services, Centers for Medicare and Medicaid Services, Texas Attorney General Medicaid Fraud Control Unit, and the Texas Department of Licensing and Regulation.

Prior to co-founding Rivas Goldstein, LLP., Mr. Rivas was an associate of Garlo Ward, L.L.P where he represented health care facilities and providers in regulatory matters. Mr. Rivas also practiced at the Texas Attorney General's office in the Elder Law and Public Health Division, where he engaged in nursing home and home health agency litigation as well as handled Medicaid fraud and Qui Tam actions. John's background also includes oil and gas litigation and representing the interests of defendants in personal injury cases while employed as an associate with Stubbeman, McRae, Sealy, Laughlin & Browder. He has also served as counsel for the Texas State Board of Medical Examiners as well served as a prosecutor in Midland County Texas where he tried over 30 jury trials to verdict.

John is a member of the Texas Association of Home Care, American Health Lawyers Association, Texas Health Care Association, Texas Association of Home and Services for the Aging and is active in the Texas Young Lawyers Association, The Hispanic Bar Association and the Austin Young Lawyers Association. He has participated in such activities as the People's Law School, National Mock Trial Competition and various Pro Bono clinics. In 1996, John was honored as the Outstanding Young Lawyer for Midland County and, in 1995, he received the West Texas Legal Services Outstanding Volunteer Award.

Juris Doctor, 1993, Texas Tech University School of Law. Bachelor of Arts in English, 1989, University of Texas at Austin. Licensed by the Texas State Bar since 1993.

Nicole A. Goldstein practices in the areas of health care, regulatory and administrative law. Ms. Goldstein advises corporations and health care providers on numerous regulatory, licensure and transactional issues, as well as consulting on health care related topics including Anti-Kickback and Stark laws. Ms. Goldstein is experienced in changes of ownership, purchasing/selling/developing health care entities, fraud and enforcement investigations and health care compliance.

Prior to co-founding Rivas Goldstein, LLP., Ms. Goldstein was an associate of Garlo Ward, L.L.P where she represented long term care facilities and providers in regulatory matters. Ms. Goldstein is also a former associate of Calinoff and Katz, in New York City, where she defended large corporations in commercial litigation suits.

Nicole is an active member of American Health Lawyers Association, Travis County Bar Association, and the Texas Young Lawyers Association. She is currently admitted to practice in Texas and New York.

Juris Doctor, 1998, Hofstra University School of Law. Bachelor of Arts in Economics and Psychology, 1995, Boston University. Licensed by the Texas State Bar since 2000. Licensed by the New York State Bar in 1999.

Nesta Gerberding, paralegal to John Rivas and Nicole Goldstein, brings outstanding research and writing skills to the firm and provides valuable support. Under the supervision of the attorneys, Nesta conducts research and drafts documents to assist the attorneys in providing the highest quality legal services.

Nesta graduated from the University of Texas at Austin in 2004 with a Bachelor of Arts in Political Science/Government and World History. Nesta is an active member of Phi Alpha Delta, placed in Regional Mock Trial tournaments in 2003, and participated in Student Government. Nesta's extra-curricular activities include co-ed Softball, skating for the Texas Roller Derby, and annual fund-raising for the Susan G. Komen Race for the Cure, which benefits breast cancer research.

Lauren Wiltenmuth is Paralegal to John Rivas and Nicole Goldstein. She provides valuable legal support under the supervision of the attorneys. She assists in finalizing legal documents, license applications and correspondence.

Lauren is currently a student at Austin Community College and plans to graduate with an Associates of Applied Science in December 2007. She then plans to complete her B.S. at Concordia University. Lauren is a member of Sigma Sigma Sigma Sorority since her attendance at University of Louisiana-Lafayette and has participated in fundraising efforts for St. Jude's Children's Hospital. Lauren is also a member of the United States Army Reserve where she currently holds the rank of Sergeant. She was awarded the Bronze Star for outstanding support during Operation Iraqi Freedom in 2004, where she served as an Intelligence Analyst for the battalion. Lauren's leisure activities include spending quality time with her family and equestrian sports.
